It's because we don't know if it's a bug that Death Strike heals even if it doesn't land or not. Blizzard has been awfully silent about the whole thing so for now I am going to assume it is a bug.

They're probably debating it back and forth. Some want it, some don't want it, so they'll leave it around for a while till they've gathered enough data to truly decide.
